Holmquist + Gardiner, PLLC attorneys are ready to help with your diverse legal needs. From developers to employers to business owners to landlords, our team of ethical and dedicated professionals will work diligently for the best possible outcome for each unique legal situation.

Litigation

Legal representation requires a balanced approach between aggressive action and smart decision making based on the law and case facts. A single lawsuit can significantly impact your business’s ability to achieve its objectives. We strive to limit the impact of litigation on our clients by formulating an effective strategy at the beginning of each case.

Our attorneys represent plaintiffs and defendants in a variety of litigation, including the following:

  • Contracts
  • Construction
  • Real estate litigation
  • Business disputes
  • Employment disputes
  • Arbitration, mediation, and alternative dispute resolution

Business

Holmquist + Gardiner attorneys regularly assist clients with business matters ranging from formation and management of business entities, to purchase or sale of businesses and assets. Our attorneys also assist clients with general day-to-day business needs. Regardless of service, our end goal is the same: mitigate the risk to our clients and provide value-added advice aimed at aiding the continuation of profitable operations.

Holmquist + Gardiner attorneys provide our clients with general counsel on day-to-day issues without the substantially higher cost of large firm representation. Should the need arise, we have established relationships with attorneys focused in a variety of more specialized practice areas.

Regardless of whether we provide the service, our business model enables our clients to obtain the highest quality of legal counsel for their particular matters. Additionally, when co-counsel services are required, we monitor billing and ensure that the client receives value-added services.

Our dedication to obtaining the best possible result for our clients supersedes our desire to keep all of the work in house.

We regularly assist clients with the following:

  • Review of contracts
  • Review and amendment of corporate documentation
  • Corporate and partnership reorganization
  • Transfer of ownership interests/shares
  • Business disputes
  • General business advising
  • Employment disputes
  • Litigation of business disputes

Construction

Effective construction law and litigation involve the understanding and application of the varied areas of the law to the specific issues and problems that arise in this specialized industry. Our many years of construction legal experience enable us to provide high-quality legal service in connection with virtually any industry-specific issues, problems, and matters.

Our attorneys assist our clients with nearly every legal issue faced in the construction industry:

  • Contract preparation, review, and negotiation
  • Lien preparation and filing
  • Construction defect lawsuits
  • Dispute resolution, including mediation, arbitration, and litigation
  • Pre-litigation strategy and negotiation
  • Bond claims
  • Claims from the Department of Labor & Industries (L&I)

Real Estate

The cost of litigation is far greater than the cost of having an attorney review documents and related risks prior to a transaction’s completion. Clients have a constant eye on the balance between their bottom line and reducing risk. Accordingly, we do everything possible to provide value-added review of contracts, transactions, and projects. We offer competitive billable rates and our invoices are in line with our estimates. Clients are not billed for unnecessary, redundant review or the learning curve of a team of associates.

Commercial and Residential Acquisition and Sale
We recognize that each real property transaction is different and each client has a different level of sophistication or desired assistance. We are experienced in both sophisticated transactions where a granular approach is required, and more traditional transactions, where there is substantially less risk, and less attorney time may be required (or desired). Accordingly, we work with the client to evaluate their needs first, and then move forward. Our services range from simple review and drafting of the purchase and sale agreement, through being an integral part of the transaction from the letter of intent stage through closing and beyond. Depending on the client’s needs, we assist with review of title, due diligence, financing documents, and review of closing documentation among other issues that can arise in a typical transaction.

Commercial Lease Review
We routinely represent landlords and tenants in negotiating and drafting commercial leases for office, retail, or industrial space. The goal is to facilitate a fair balance between a landlord’s risk in allowing a tenant to occupy space, and the fair allocation of risk and cost to a tenant in exchange for that opportunity. While leases are replete with form language, parties to a lease should be aware of the meaning of that language and the substantial risks associated with the same. Likewise, parties need to be aware of how to protect their assets and their ability to continue income to cover debt maintenance obligations.

We routinely advise clients on other real estate matters including but not limited to:

  • Residential and commercial eviction
  • Real estate development
  • Condominium creation
  • Condominium conversion
  • Home owners association (HOA) creation and advising
  • Earnest money disputes
  • Property management issues

Employment

Consistent with our goal of helping our clients mitigate risk, we believe that time spent upfront drafting an employment contract or developing an employee handbook can reduce risk down the road.
